By visiting, viewing, using or registering as an au pair or family on the Aupair.za.com website, confirms that the user has read and accepted the terms and conditions thereby creating a binding legal agreement.

Aupair.za.com has the right to change and amend the terms and conditions at any point in time, therefore users must read the terms and conditions every time when visiting the website.

Payments
Searching the Aupair.za.com website is free of charge, but users have to register as a Premium Member to gain access to the contact details, that is: email addresses, telephone numbers and postal addresses, as provided by the au pair or family.
The above mentioned, is the only part of Aupair.za.com’s services that users have to pay for. Further information can be found under the heading “Becoming a Premium Member”

Refund policy
There are no refunds on paid Premium Memberships. Should the user cancel or deactivate his/her Premium Membership prior to the end of your 90-day membership period, there will not be any proportional refund.

Liability for profile information
The information provided by the users of Aupair.za.com when registering on the website, is the solely the responsibility of the user.

Users must provide accurate, truthful, up-to-date, correct information when registering on the Aupair.za.com website. Most importantly, users must provide complete and one hundred percent accurate personal and contact data, that is first name, surname, valid email address, postal address etc. on the Aupair.za.com website.

It is the responsibility of each user to verify, correct and update his/her data after registration and any other time thereafter when there is a change on the indicated data.

Users are allowed to delete their registration/profile at any time during or after registration.

User registration obligation
All data, personal and contact data of au pairs or host families are confidential and should be treated like that at all times. It is forbidden to convey any data, personal or contact data, to other users, employment or au pair agencies etc.

Each user will agree and adhere to the terms and conditions during the registration process. Any violation of the terms and conditions will result in immediate cancellation of the user’s registration and membership and blocking access to the Aupair.za.com website.

Registration on the Aupair.za.com website must be done by the respective au pair or family him/her/themselves. Registration for someone else or on behalf of someone else is forbidden.

Duplicate and repeated registrations are not allowed.

The following people and/or companies are not allowed to register or become Premium Members on the Aupair.za.com website.

1. People under the age of 18 years old
2. Owners and/or employees of au pair and/or employment agencies
3. Competitors of Aupair.za.com
4. Advertisers of any type of service or product

Aupair.za.com reserves the right to verify and check contact information of registered users.

Aupair.za.com may delete unlawful mismatching registrations.

Users are not allowed to include any contact details or data in fields which are not specified or intended for contact information. All contact information, e.g. telephone numbers, addresses, email details must be detailed under the specific sections during the registration process.
To publish any contact details in unauthorised fields no matter in which format (text or numbers) or language, is an offense and violation of Aupair.za.com’s terms and conditions. The user’s registration will be deleted by Aupair.za.com and the necessary law enforcement procedures will be followed if necessary.

All information to get in contact with a particular au pair or host-family is considered as contact data and can be found under the heading “Becoming a Premium Member”. Aupair.za.com only allows registered Premium members to view and access the contact information of a specific au pairs or host-family.

It is solely the responsibility of the user to ensure the secrecy and confidentiality of his/her password. It would be a breach of the terms and conditions by the user if he/she discloses/tells/conveys password information to someone else.

Warranty disclaimer and limitations of liability
Services and information published and provided by Aupair.za.com are provided on a “as is” basis with no warranties.

At Aupair.za.com, we do not guarantee or make any warranties on the completeness, correctness, accuracy, quality or validility on the information as provided by the users, whether it be the au pair or host family.

Aupair.za.com does not review or confirm the accuracy and truthfulness of any content, au pair or family information or registration postings on the site; however we do reserve the right to terminate any registration, remove any content, block access to the website and reject any information in contradiction to the terms and conditions of this website.

Aupair.za.com does not guarantee a complete technology-error-free program, registration or payment process. Users must be aware that data will be available at some time and/or not at all.

Aupair.za.com further disclaims any warranties, without limitation, for the security, reliability, timeliness, and performance of this web site. We do not warrant that the functions on the Aupair.za.com website will be uninterrupted or error-free, that defects will be corrected or that the Aupair.za.com site and server are free of viruses, worms or other harmful components and material that some my deem objectionable. Communication on the Aupair.za.com site, the use of the site and any content herein is at the user’s own risk.

All the necessary arrangements and documentation between au pairs and families, for example, contacting each other, flight and visa arrangements, employment contracts and agreements, compensation, salary, wages matters etc. are at each party’s sole discretion and at the au pair’s or family’ s expense. All information submitted and conveyed through the Aupair.za.com site is done at the user’s own discretion and will the user be solely responsible for any damage and/or loss of any data and information that may occur during or after the registration process.

Aupair.za.com is not be liable for any losses, lost wages, direct or indirect, incidental, special or any other damages that result from the use of or the inability to use the Aupair.za.com website and its services. Users of the Aupair.za.com specifically acknowledge and agree that Aupair.za.com is not liable for any defamatory, offensive or illegal conduct of any third party site or any user of the Aupair.za.com website.

Aupair.za.com does not have any ownership rights to any information published by users on our website. However by submitting your information on our website, we may use and display your information on the Aupair.za.com website.

Indemnity
Any user of the Aupair.za.com website agrees to indemnify Aupair.za.com for all costs, damages, liabilities, charges and any expenses, including attorney’s fees, which Aupair.za.com may occur as a result of the user’s breach or violation of the Terms and Conditions by him/herself or any infringement by any other person acting or using the user’s account.

Governing law
Aupair.za.com adheres to the South African laws, therefore any legal matter relating to the use of this website or its services will be analysed and interpreted in accordance with the South African laws without regard to conflicts of law principles. Furthermore, any claims or disputes against Aupair.za.com will be held in the courts of South Africa.

Entire agreement
